1. Acceptance of Terms

By downloading or using the EvaShark mobile application (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Age Requirement: You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

2. Medical & AI Disclaimer

EvaShark is not a medical device. The information provided, including AI-generated insights, workout plans, and nutrition suggestions, is for educational and wellness purposes only.

AI Insights: Our Service uses artificial intelligence to provide personalized wellness recommendations. While we strive for accuracy, AI models can make mistakes or provide incorrect information. All AI-generated content is provided "as-is" without any warranties. You should always use your own judgment and consult with a healthcare professional before making significant changes to your diet or exercise routine.

⚠️ EvaShark is NOT intended for use as a form of contraception.

The Service and its predictions should not be used to prevent pregnancy.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on EvaShark.

3. Subscriptions and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle").

Billing and Cancellation

Subscriptions are managed through the Apple App Store. You can cancel or manage your subscription at any time by going to your:
iOS Settings > Apple ID > Subscriptions

Important: Deleting the EvaShark app from your device does not automatically cancel your paid subscription. You must cancel the subscription manually via your App Store settings to avoid further charges.

Refunds

Refund requests must be processed through the Apple App Store support channels. EvaShark does not have the ability to issue refunds for transactions processed by Apple.

4. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of EvaShark and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of EvaShark.

6. Limitation of Liability

In no event shall EvaShark, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any reliance on health, fitness, or AI-generated nutritional advice;
  • Any unauthorized access to our servers and/or any personal information stored therein.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
